If you do not agree to these Terms of Use, please do not use the site or participate in Treasure Trove Toronto events.

4. User Conduct
4.1. Standards of Conduct
Users of the Treasure Trove Toronto website and participants in our events are expected to conduct themselves in a respectful, lawful, and courteous manner. This includes refraining from posting or transmitting any content that is defamatory, obscene, threatening, invasive of privacy, abusive, illegal, or otherwise objectionable.
4.2. Prohibited Activities
The following activities are strictly prohibited on the Treasure Trove Toronto website and at our events:
Posting or transmitting any unlawful, harmful, threatening, abusive, harassing, defamatory, or racially, ethnically, or otherwise objectionable content.
Engaging in any activity that would constitute a criminal offence or give rise to civil liability.
Using the website or events to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Uploading or transmitting viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another computer or property of another.
4.3. Right to Monitor and Remove
Treasure Trove Toronto reserves the right, but not the obligation, to monitor the content submitted to the website and to determine compliance with these Terms of Use and any other operating rules established by us. In our sole discretion, we have the right to edit, refuse to post, or remove any material submitted to or posted on the website.
4.4. Right to Terminate Access
Treasure Trove Toronto also reserves the right to terminate or restrict your access to the website and/or your participation in any of our events if we determine, in our sole discretion, that you have violated these Terms of Use or that your conduct would be harmful to the interests of other users, associates, or Treasure Trove Toronto.
4.5. Reporting Misconduct
If any user of the Treasure Trove Toronto website or participant in our events behaves in a way that contravenes these Terms of Use, other users can report this behaviour to Treasure Trove Toronto. Upon receiving such reports, we will take the necessary action, which may include removing content, issuing warnings, or suspending or terminating accounts.
4.6. Liability for Conduct
Users are solely liable for their conduct and any content that they submit, post, or transmit via the Treasure Trove Toronto website or during events. Users agree to indemnify and hold harmless Treasure Trove Toronto against all claims, losses, expenses, damages, and costs, including reasonable attorney fees, resulting from any violation of these Terms of Use by them.
5. User Generated Content
5.1. Content Ownership and Responsibility
User Ownership: Users retain ownership of the content they submit, post, display, or otherwise make available (collectively, “submit”) on the Treasure Trove Toronto website, including business profiles and listings.
User Responsibility: Each user is solely responsible for the content they submit and the consequences of posting or publishing it. Users affirm, represent, and warrant that they own or have the necessary licenses, rights, consents, and permissions to publish the content they submit.
5.2. Licence to Use User Content
By submitting content to Treasure Trove Toronto, users grant Treasure Trove Toronto a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the user-submitted content in connection with the Treasure Trove Toronto website and its (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Treasure Trove Toronto website (and derivative works thereof) in any media formats and through any media channels.
5.3. Content Standards and Removal
Standards: Users must ensure that their content complies with all applicable laws and regulations and does not infringe any third-party rights. The content should not be misleading, malicious, discriminatory, illegal, or obscene.
Treasure Trove Toronto’s Right to Remove: Treasure Trove Toronto reserves the right, but not the obligation, to review, screen, delete, move, or edit without notice any content submitted, for any reason or no reason at all, at its sole discretion, without liability.
5.4. No Endorsement of User Content
No Endorsement: Treasure Trove Toronto does not endorse any user-generated content or any opinion, recommendation, or advice expressed therein. Treasure Trove Toronto expressly disclaims any and all liability in connection with user-generated content.
5.5. User Representations and Warranties
Users represent and warrant that their content:
- Complies with these Terms of Use.
- Is accurate and not confidential.
- Is not in violation of any contractual restrictions or other third-party rights.
5.6. Indemnification for User Content
Users agree to indemnify and hold harmless Treasure Trove Toronto, its affiliates, officers, agents, employees, and partners from any claim or demand made by any third party due to or arising out of content they submit, their use of the website, or their violation of these Terms.
5.7. Content Review and Modification
Treasure Trove Toronto reserves the right to review, modify, or delete any content that violates these Terms of Use or that is otherwise objectionable, at its sole discretion and without prior notice to the user.
6. Free and Paid Business Listings
6.1. Free Listings
Business owners are eligible to create a free listing on the Treasure Trove Toronto website. This listing includes basic business information and is available to all business owners subject to our approval.
6.2. Paid Subscriptions
Business owners have the option to upgrade their free listing to a premium subscription on a monthly basis. The premium subscription offers additional features and benefits, enhancing the visibility and engagement of their listing.
6.3. Subscription Changes
To maintain consistency and reliability in our listings, business owners are limited to changing their subscription type (from free to paid or vice versa) no more than three times per calendar year. This limitation is in place to prevent frequent, disruptive changes to the listings and to ensure a stable and dependable experience for consumers.
6.4. No Minimum Subscription Period
While there is no minimum subscription period for the premium listings, the restriction on the frequency of subscription changes as mentioned in 6.3 applies.
6.5. Week-Long Boosts
In addition to the subscription options, business owners have the opportunity to purchase a week-long boost for their listing. This boost is available for both free and premium listings.
6.6. Unlimited Boost Purchases
There is no limit to the number of times a business owner can purchase a week-long boost. However, each boost purchase will last for a consecutive seven-day period.
6.7. Boost Purchase Conditions
Boost purchases are subject to availability and must comply with the guidelines and standards set forth by Treasure Trove Toronto. We reserve the right to refuse a boost purchase if it does not align with our policies or standards.
6.8. No Refunds on Boost Purchases
All boost purchases are final and non-refundable, except in circumstances where Treasure Trove Toronto is unable to deliver the boost due to technical or operational issues.
7. Intellectual Property
All content on the Treasure Trove Toronto website, including text, graphics, logos, and images, is the property of Treasure Trove Toronto or its content suppliers and is protected by Canadian and international copyright laws.
8. Disclaimer of Warranties
The site and the materials, information, services, and products included on it are provided “as is” and without warranties of any kind.
9. Limitation of Liability
Treasure Trove Toronto will not be liable for any damages of any kind arising from the use of this site or from participation in the events, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
10. Indemnification
You agree to indemnify and hold harmless Treasure Trove Toronto, its officers, directors, employees, and agents from and against any claims, actions, demands, liabilities, and settlements.
11. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
